- 10-Day Notice to Pay Rent or Terminate (nonpayment) — ORS 90.394(2)(a).

3How the Oregon notice period is counted
- Oregon periods based on a number of days are consecutive calendar days: the day of service is not counted, the last day counts until 11:59 p.m. (ORS 90.160(1)).
- If the notice is served by first class mail, the minimum period is extended by three days, and the notice itself must state that extension (ORS 90.155(2)). Personal delivery needs no extension — keep dated proof of which method was used.
- A nonpayment notice cannot be served too early: the 10-day notice no sooner than the eighth day of the rental period, the 13-day alternative no sooner than the fifth day, and the week-to-week 72-hour notice no sooner than the fifth day (ORS 90.394).
- A for-cause notice runs two clocks: the cure deadline (at least 14 days after delivery for a curable violation) and the termination date (at least 30 days after delivery) (ORS 90.392(3)-(4)).
4Mistakes that get an Oregon eviction notice thrown out
- Omitting the rental assistance notice. Oregon requires the landlord to deliver, with any nonpayment termination notice, the notice posted by the Judicial Department under ORS 105.136 — and a court must dismiss a possession complaint based on nonpayment if that notice was not delivered (ORS 90.395(2)-(3)).
- Serving the nonpayment notice before the statute allows. The 10-day notice may be given no sooner than the eighth day of the rental period (the 13-day variant: the fifth day; the week-to-week 72-hour notice: the fifth day) (ORS 90.394).
- Leaving out the amount due or the payment deadline. The nonpayment notice must specify the amount of rent that must be paid and the date and time by which the tenant must pay (ORS 90.394(3)).
- Forgetting the relocation payment after the first year. A qualifying-reason termination requires one month's rent paid to the tenant at delivery of the notice, unless the landlord has an ownership interest in four or fewer residential dwelling units (ORS 90.427(6)).
- Filing before the notice has run. An action to recover possession may be maintained only when the termination notice has been served, for the period the statute prescribes, before the action is commenced (ORS 105.116(2)-(3)). A possession action filed too early is vulnerable to dismissal.

How many days does an Oregon eviction notice give for unpaid rent?
At least 10 days for most tenancies, delivered no sooner than the eighth day of the rental period — or at least 13 days if served no sooner than the fifth day. For a week-to-week tenancy, at least 72 hours, served no sooner than the fifth day (ORS 90.394). The notice must state the amount due and the date and time of payment, and it must be delivered together with the Judicial Department rental assistance notice (ORS 90.394(3), 90.395(2)).
What eviction notice is used for a lease violation in Oregon?
A written notice to terminate for cause: it must describe the violation, give a termination date at least 30 days after delivery, and offer a cure date at least 14 days after delivery if the violation is curable (ORS 90.392(3)-(4)). A repeat of the same violation within six months shortens the notice to 10 days with no cure (ORS 90.392(5)(a)); for week-to-week tenancies the periods become 7 and 4 days (ORS 90.392(6)).
How much notice ends a month-to-month tenancy in Oregon?
During the first year of occupancy, the landlord ends a month-to-month tenancy with 30 days' written notice; the tenant may always give 30 days (ORS 90.427(3)). After the first year, the landlord needs a qualifying reason — demolition, conversion, repairs, own or family occupancy, or sale to an occupant-buyer — with 90 days' notice, or 60 days plus one month's rent paid at service in the sale case (ORS 90.427(5)). Week-to-week: 10 days (ORS 90.427(2)).
Can an Oregon tenant stay in the property after the notice expires?
Yes. The notice is the required first step, not the eviction. If the tenant does not pay, cure or leave by the deadline, the landlord must file a forcible entry and detainer action under ORS 105.100 to 105.168 and obtain a court judgment before recovering possession. Self-help measures such as changing the locks are unlawful.
Is there a faster Oregon eviction notice for serious problems?
Yes. For serious acts — substantial personal injury, reckless endangerment, intentional substantial damage to the premises, certain application fraud, or conduct outrageous in the extreme — the landlord may terminate after 24 hours' written notice specifying the acts and the date and time of termination (ORS 90.396(1)). The 24-hour notice is not generated by this template.
How must an Oregon eviction notice be served?
By personal delivery or by first class mail (ORS 90.155(1)); if served by mail, the minimum period is extended by three days and the notice must say so (ORS 90.155(2)). Other methods — mail plus attachment to the premises, or email — apply only if a written rental agreement or addendum provides for them (ORS 90.155(1)(c)-(d)). Keep dated proof of delivery.
