How many days does a Virginia eviction notice give for unpaid rent?

14 days after written notice. If rent is unpaid when due and the tenant fails to pay within 14 days after written notice of nonpayment and of the landlord's intention to terminate, the landlord may terminate the rental agreement (Va. Code § 55.1-1245(F)). This period was amended from 5 to 14 days in 2025 — older forms and compilations are out of date.

What notice does a Virginia lease violation require?

A written notice that the rental agreement will terminate on a date not less than 30 days after receipt if the breach is not remedied in 21 days (Va. Code § 55.1-1245(A)). For a breach that is not remediable, the notice gives 30 days with no cure right; criminal or willful acts threatening health or safety allow immediate termination (§ 55.1-1245(C)).

How much notice ends a month-to-month tenancy in Virginia?

Written notice served at least 30 days prior to the next rent due date (Va. Code § 55.1-1253(A)) — termination takes effect on a rent due date, not simply 30 days after delivery. A week-to-week tenancy takes 7 days. The rental agreement may provide a different notice period.

Can a Virginia tenant stay after the eviction notice expires?

Yes. The notice is the statutory first step, not the eviction. The landlord must then file an unlawful detainer action (§ 8.01-126) and obtain a court order for possession before the tenant can lawfully be removed. Self-help eviction is not lawful.
